COVID Injury Network operates as a lead generation and attorney referral service specializing in COVID-19 vaccine injury cases. Our services include:

Initial case evaluation and screening
Attorney-client matching and referral services
Educational resources about legal rights and compensation
Communication facilitation between clients and legal professionals
Information gathering for preliminary case assessment

3. Liability Limitations and Damage Caps

Maximum Liability Limitation

LIMITATION OF LIABILITY: The total liability of Company for any and all claims arising under or relating to these Terms or your use of our services shall not exceed the lesser of: (i) the total amount paid by User to Company in the twelve (12) months preceding the claim; or (ii) $1,000.

Exclusion of Consequential Damages

DAMAGES WAIVER: Neither party shall be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

Lost profits or revenue
Lost data or business interruption
Loss of business opportunities
Emotional distress or pain and suffering
Legal fees or court costs

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability) and even if advised of the possibility of such damages.

Time Limitations for Claims

STATUTE OF LIMITATIONS: Any claim arising under these Terms must be brought within one (1) year after the cause of action accrues, or such claim shall be permanently barred. This limitation applies to the maximum extent permitted by law.

4. Indemnification and Hold Harmless Provisions

User Indemnification Obligations

INDEMNIFICATION BY USER: User agrees to defend, indemnify, and hold harmless Company, its affiliates, officers, directors, employees, agents, contractors, and legal partners from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:

User's breach of these Terms or violation of any law or regulation
User's use or misuse of the services
User's submission of false, inaccurate, or misleading information
Any third-party claim related to User's content, conduct, or actions
User's violation of any third-party rights, including intellectual property rights

Company Indemnification Limitations

COMPANY INDEMNIFICATION EXCEPTIONS: Company's indemnification obligations, if any, shall not apply to claims arising from:

User's modification or misuse of provided information
Actions by third-party attorneys or legal professionals
User's failure to follow legal advice or instructions
Outcomes of legal proceedings or settlements

Class Action Waiver

CLASS ACTION WAIVER: User agrees that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class action, collective action, or representative proceeding. User expressly waives the right to participate in any class action lawsuit or class-wide arbitration.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be conducted exclusively in Delaware state or federal courts.

10. Service Modifications and Termination

Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of services.

Account Termination

TERMINATION RIGHTS: We may terminate or suspend your access immediately, without prior notice, for any reason including breach of these Terms, fraudulent activity, or violation of applicable laws.
